Another strike in the win column for anti-online defamation law and reputation management.  A supreme court ruling in British Columbia has awarded the defendant in the latest case to pay $200,000 in damages, plus $40,000 to cover reputation consultant costs, plus legal fees.

The ruling by Justice Elliott Myers stated: “the courts have recognized that the internet can be used as an exceedingly effective tool to harm reputations. This is one such case.” 

According to the ruling, Vancouver native Noelle Halcrow made a series of false online posts that claimed her ex-boyfriend, Brandon Rook, had a sexually transmitted disease, was an alcoholic and had cheated on her.  Halcrow posted the defamatory content on Instagram and three other websites soon after Rook ended their romantic relationship. 

Halcrow tried to deny that she posted the content; instead, claiming it was friends of the former couple who was responsible.  Despite her claims, Justice Myers rejected the plea on four facts:

  • Halcrow’s IP address was used to make the posts
  • Rook had text messages from Halcrow threatening to put up the posts
  • The posts were very similar to texts that she had sent.
  • Halcrow had the motivation to make the 92 offensive posts.

To guide him in his ruling, Justice Myers examined two recent cases around online defamation in British Columbia; the first of which involved a wedding planner who was awarded $115,000 after a customer made several social media attacks about the business.  In the second case, the B.C Recreation and Parks Association was awarded $106,000 over false accusations made online.  

An injunction in the case also prevents Halcrow from ever re-posting any of the offending content online in the future.  

With the popularity of the internet and social media sites, defamation claims are surfacing more often than not.  Typically, once a defamatory statement is published on the Internet, the damage is already done. On the bright side, cases like Rook Vs. Halcrow are proving that a person better think twice before hitting the ‘post’ button on derogatory content about someone else.

In the latest round of data breaches, this week Adult Friend Finder confirmed that their database had been breached, exposing the private information of millions of users of the site, as well as a host of other sites run by Friend Finder Networks, including Cams.com, Penthouse.com, and Stripshow.com.

To add to the bad news, this week’s Adult Friend Finder data breach is 10 times larger than last year’s Ashley Madison hack.  It’s estimated that more than 412 million accounts within the Friend Finder Networks have been exposed, including deleted accounts.  This week’s breach is the largest hack since the information of 359 million MySpace users was leaked in 2013.

It’s reported that the exposed private information of Adult Friend Finder users includes email addresses, passwords, dates of last visit to the website, IP addresses and browser information.

Last year, the hack of roughly 37 million Ashley Madison accounts was not only a reputation threat to millions of individuals, it also served as an ideal opportunity for extortionists looking to blackmail those impacted.

Yesterday, on August 19th, a hacker group called The Impact Team publicly released an enormous 9.7 GB download of data from Ashley Madison’s servers.

Earlier this year, an announcement was made that will make a significant impact on company brand image and the online reputation management for businesses.  It was announced that 500 new Generic Top-Level Domains (gTLDs) would be available for purchase and use by the public.  Not a big deal, except the fact that some of these newly-available domains include things like .sucks and .gripe and a number of other domain names that could cause very real trouble for the online reputations of companies.

Right now, businesses should focus on the .sucks domain.  That’s because on April 1st, a 60-day “sunrise period” began allowing companies to buy up the .sucks domain associated with their company (i.e. homedepot.sucks, target.sucks, etc.) and thereby protect their brand image.

Providing an opportunity for companies to buy up their .sucks domain before the domain is open to the public sounds like a fair and good idea. Unfortunately, there’s a wrinkle in the road, that wrinkle being a company that’s making it difficult, not to mention unfairly expensive, for companies to buy their .sucks domain.

Canadian-owned Vox Populi Registry Ltd. was given the rights to manage the sale of the .sucks domain.  However, how they are managing this responsibility has recently fallen into question.  Currently, Vox Populi is charging trademark holders up to $2,499 (U.S.) per year to have control over their .sucks domain.

 

Companies and the IP community have protested about Vox’s pricing, which is about 10 times more expensive than what the price will be for .sucks domains once they are open to the public.  What is perhaps worse is the fact that Vox plans to subsidize .sucks domains for $9.99 to interested parties on the third-party bulletin board, Everything.Sucks, which strikes of extortion.

So, in this situation, what should companies do?

Many big brands have given in and taken the ‘rather than safe than sorry’ route by buying up the .sucks domain associated with their brand.

It’s unfortunate that when working to obtain their .sucks domain, companies have little leeway other than dealing with Vox Populi.  At this point, it’s doubtful whether that will change during this sunrise period.

Therefore, for those companies that want to assure that their brand remains intact and that no .sucks websites suddenly appear in their Google ranking that criticize their business, it’s best that they purchase their .sucks domain, despite the exorbitant cost.

When it comes to protecting your brand against a viable online reputation threat, it’s important to act rationally and preventatively despite the unpleasantness of giving in to extortion.

Shark Tank is a show on ABC that invites budding entrepreneurs to present their business ideas to business titans that include billionaire and owner of the Dallas Mavericks, Mark Cuban, the show’s host Robert Herjavec, real estate mogul Barbara Corcoran, venture capitalist Kevin O’Leary, and branding and fashion expert Daymond John.


Last Friday, Shark Tank invited Patrick Ambron to the show, who is the co-founder and CEO of the online reputation management company, BrandYourself.


What’s noteworthy about BrandYourself’s appearance on Shark Tank was that the show’s host, Robert Herjavec, offered a very large $2 million investment in BrandYourself in return for 13.5% of the company.

This $2 million proposal was the largest offering in Shark Tank’s history.

Although the deal between Herjavec and Ambron ultimately fell through, the amount that Herjavec was willing to front BrandYourself, and the confidence that Herjavec showed in the future of online reputation management, speaks well of the industry as a whole.
